Victimisation

Being treated less favourably because of a ‘protected act’ which is:

  1. Making a complaint of discrimination in good faith
  2. Giving evidence when somebody else complains of discrimination

Victimisation cannot be justified

Examples:

  • A female employee is dismissed after complaining that she is receiving less pay than a male colleague in an equivalent job role with similar experience and qualifications.
  • A worker is passed over for promotion because they made a witness statement supporting another colleague’s complaint of discrimination.

    ever since i had a heated meeting with my managers on hiding my medical report for three months, soon after that particular meeting my manager came to me and said since i owed the company 600pounds they have to split my payments monthly but i objected, i did not want their help, i insisted they take it in one go but the manager refused. and now am suffering, have alittle 3months baby, and got a letter that they are going to start paying me by cheque coz they dont want to end up overpaying me.

    it has never happened in this company for the 4yrs i have been working here.and today i got a letter that i they are going to deduct 534pounds from my pay because according to them i requested them to take the money in one go of which i didnt.this is three months after the manager insisted on monthly deductions.and being that im black i feel these people treat me this way coz of my colour.last week my partner got sick and i did not turn up and the next day the maneger indirectly said it does not concern them but i should be at work.how can i be at work when the mother fo my baby is not well, who will take care of my baby.the supervisor does not listed to me, last time i told them i had a back pain on workin on this particular machine but they didnt say a thing but let me still work on that machine for 4 days until i threatened leagl advice .ant this time the hid my medical report because it was testifying against them. in that report it states i should not be working on tha machine for 2weeks upon receiving the report but they hid it so i cant see it and all this time they let me work on that machine knowing i shoul not. im itred and stressed and its affecting my girfrend, when i asked them why the did not consult me about the details in that report the reason i got was we wer busy doing redundancy papaers for 2people. pliz help, i cant cope

    at the moment they are always watching me with hatred, how will i take care of my baby if they diduct all that amount and to make matters worse im moving house this week and was expecting my pay to cover rent and deposit. what shud i do, i have a three months baby.

    I am afraid that we cannot give legal advice through the website but there are a couple of things you can try.

    You don’t say if you are a member of a union. If you need to find out which union you can join then take a look at http://www.worksmart.org.uk/unionfinder/
    Unions exist to represent and protect you in exactly these kind of situations but they can’t help if you are not a member.

    The Equality and Human Rights Commission has a helpline and they should be able to give you some advice. The number is 08456 048 810.

    You could also try contacting the Citizen’s Advice Bureau because they can sometimes offer financial counselling to manage money problems. Look on http://www.citizensadvice.org.uk/ to find out who you need to contact.
