
Individuals are liable for acts of discrimination that they commit and could have a claim made against them, through an internal grievance procedure and also through employment tribunal.
Vicarious Liability
The employer is liable for acts of discrimination that are committed by its employees which are done ‘in the course of employment’.
(This can include social events such as Christmas parties).
The employer can defend themselves from a claim of discrimination if they have taken ‘reasonable steps’ to prevent discrimination from occurring in the first place.
