- Treating someone less favourably because of their [gender, race, disability, age, sexual orientation or religion or belief] or because of their perceived [age, race, sexual orientation] and
- They have suffered a detriment (ie a loss or harm) and
- The employer cannot justify the discrimination.
NB Direct Age discrimination can sometimes be justified, but this is not the case for the other equality strands.
Examples:
- An organisation has a practice of only promoting people under the age of 50, which amounts to treating people over 50 less favourably.
- Not employing a woman in the belief that she may take a career break to have children.
- Disabled people are automatically rejected when applying for a job, without considering how reasonable adjustments could be made.
I have been temping with a company for 2 1/2 months leasing apartments and got hired on June 23, 2008. 3 other employees got to move in on property right away and now they are telling me i have to wait 90 days to move in. The regional told me that she wasn’t paying attention before and that it’s the policy so it doesn’t matter that they got to move in. I would like to know if there is anything I can do.
26 June 2008 at 7:03 pmIt doesn’t seem clear whether this is an equality issue or if it is a general employment related issue. I’d suggest contacting your union for advice since they are better placed to support you, especially if it is a contractual issue.
