Disability Due regard to the need to: Promote equality of opportunity between disabled persons and other persons Eliminate discrimination Eliminate harassment Promote positive attitudes towards disabled persons Encourage participation of disabled persons in public life Take steps to take account of disabled persons’ disabilities; even where that involves treating disabled persons more favourably than other persons. |
Gender Due regard to the need to: Eliminate unlawful discrimination and harassment To promote equality of opportunity between men and women |
‘Due regard’ comprises two linked elements: proportionality and relevance. ‘Due regard’ means to give due weight to the need to promote equality in proportion to its relevance. It requires more than simply giving consideration to equality.
A preliminary assessment of policies and services will identify areas for action. Where the specific duty applies, a thorough impact assessment of policies can be carried out to determine appropriate actions in depth.
